§ 1 Scope of Application

(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts between Joanna Seiffert (hereinafter "Provider") and its customers concerning the services offered by the Provider.

(2) Deviating terms and conditions of the customer shall not be recognised unless the Provider expressly agrees to their applicability in writing.

§ 2 Conclusion of Contract

(1) The presentation of services does not constitute a legally binding offer, but rather an invitation to submit an offer.

(2) The contract is concluded upon acceptance of the customer's offer by the Provider. Acceptance is effected by an order confirmation in text form or by rendering the service.

§ 3 Prices and Payment Terms

(1) The prices agreed upon at the time of conclusion of the contract shall apply. All prices are inclusive of the applicable statutory value added tax, unless otherwise stated.

(2) Payments are due within the agreed period. In the event of default in payment, the Provider is entitled to charge default interest at the statutory rate.

§ 4 Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.

Withdrawal Policy

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments we have received from you, without undue delay and in any event no later than fourteen days from the day on which we received notification of your withdrawal from this contract.

§ 5 Liability

(1) The Provider shall be liable without limitation for intent and gross negligence, as well as in accordance with the provisions of the Product Liability Act.

(2) In cases of slight negligence, the Provider shall only be liable for damages arising from injury to life, body or health, as well as for damages arising from the breach of material contractual obligations, the fulfilment of which is essential to the proper performance of the contract and upon the observance of which the customer may regularly rely.

(3) Any further liability of the Provider is excluded.

§ 6 Final Provisions

(1) The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected thereby.

(3) The place of performance and the exclusive place of jurisdiction for all disputes shall be — to the extent permitted by law — the registered seat of the Provider.
